2/ Application of the GTC
Les présentes conditions générales de vente s’appliquent à toutes commandes prises sur le site Internet www.caviar-de-neuvic.com. Elles sont exclusives de toute autre condition d’achat des clients, qui sont inopposables à HUSO.
3/ Applicable law and jurisdiction
These terms and conditions are subject to French law. In the event of a dispute, the competent court shall be that of the defendant's place of residence or, at the defendant's discretion, the place of actual delivery of the product.
4/ Data Protection Act
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders and issuing invoices. Failure to provide this information will result in the order being invalid. The customer gives their consent to the use of personal data collected under the terms of this order for HUSO's customer database. The customer has the right to access and rectify this data at any time by contacting HUSO.
5/ Validity of the offer
Offers on the website are valid while they are online. The geographical area covered by the offer and delivery is mainland France, Corsica, Monaco, Andorra and European Union countries. For shipments to French overseas departments and territories and other countries, the customer must contact HUSO for information on customs regulations, delivery costs and delivery times.
6/ Acceptance of the offer
The customer will receive an e-mail summarising the details of their order.
7/ HUSO's obligations
HUSO undertakes, after confirmation of the order and validation of payment, to sell and deliver the products ordered to the designated recipient during business hours (Tuesday to Friday). Any order placed after 10 a.m. will be processed the following business day. The delivery time chosen by the customer is subject to postal delivery issues and product availability. HUSO reserves the right not to register an order in the event of force majeure and undertakes to notify the customer.
8/ Customer obligations
By placing an order, the customer agrees to take delivery of the products ordered and to pay the price, as well as the transport costs for the products and any duties and taxes related to the regulations of the country of import. More generally, the customer undertakes to comply with these general terms and conditions of sale. The goods become the property of the customer only after full payment of the price by the latter, regardless of the date of delivery of the said products. As long as ownership has not been transferred to the customer, the latter shall refrain from reselling, renting or granting rights to the products to third parties for any reason whatsoever, or from transforming them in any way whatsoever. The transfer of risk takes place upon delivery, from which date the customer undertakes to be responsible for the storage of the product for private purposes. In particular, the customer must ensure that the products are not consumed after the use-by date indicated on the label.
9/ Prices
Mainland France, Corsica, Monaco, Andorra and the European Union: prices are quoted in euros, inclusive of all taxes, excluding shipping costs. Any customs duties or other import taxes payable are the responsibility of the recipient of the shipment. Delivery costs are added to the price of the products.

10/ Payment
All purchases must be paid for before delivery. Online credit card payment: you will be redirected to the secure Société Générale website (SOGECOMMERCE), which guarantees the confidentiality of the data transmitted (in particular card number, expiry date and security code on the back of the card) through protection and encryption procedures. The shipment can only take place after acceptance by the bank.
Payment by cheque: made payable to SAS HUSO. Upon receipt of the cheque, HUSO undertakes to ship the goods. HUSO reserves the right to cancel the order of a customer with whom there is an ongoing dispute.
Any delay in payment will result in the immediate payment of all sums owed to HUSO by the customer, without any formalities or prior notice, in addition to the late payment interest provided for in Article L.441-6 of the French Commercial Code, without prejudice to any other action that HUSO may be entitled to take against the customer in this regard.
In addition, the customer in arrears shall be automatically liable to HUSO for a fixed compensation of €40 for recovery costs. If the recovery costs incurred exceed this amount, HUSO may request additional compensation upon justification.
As stated in Article 8 above, ownership of HUSO products shall only be transferred after full payment of the price by the latter, regardless of the delivery date of said products.
11/ Availability
All orders will be fulfilled while stocks last. If any products are unavailable after the order has been confirmed, HUSO will inform the customer by email or telephone within 24 hours (working days). The customer may then cancel their order or request an exchange for the products concerned.
12/ Delivery
The choice of transport and delivery method is the responsibility of HUSO. The customer undertakes to be present to receive the parcel and check its contents with the carrier. The risk of loss or damage to the products is transferred to the customer at the moment when they, or a third party designated by them, take physical possession of the products. HUSO undertakes to provide the customer with the tracking number for their parcel by email. The customer must check the parcel upon arrival in the presence of the carrier and inform HUSO of any anomalies within 24 hours.
HUSO undertakes to deliver to mainland France on the day chosen by the customer when paying for their order.
Deliveries are scheduled from Tuesday to Friday, and on Saturdays upon specific request. No deliveries will be made on Mondays, Sundays, public holidays or the day after public holidays.
In the event of absence, HUSO reserves the right to either make a new delivery the following morning with a notice from the carrier, or return the parcel directly to the place of dispatch. For quality reasons, HUSO is solely responsible for this decision.
HUSO reserves the right to choose the carrier and undertakes to deliver to the customer at the delivery address indicated on the order form. The purchaser undertakes to indicate on their order a delivery address (excluding PO boxes) where delivery can be made during business hours. Upon express request, the delivery address may differ from the billing address.
Shipping costs for mainland France and Monaco
• For orders under £130 including VAT: £22.80 including VAT
• For orders over £130 including VAT: FREE
Refrigerated transport provided by CHRONOFRESH (controlled temperature 0-4°C)
Packages must be placed in the refrigerator upon receipt by the customer.

For all orders placed before 10 a.m., delivery the next day before 1 p.m., re-delivery the next day in case of absence. Packages must be refrigerated upon receipt by the customer.
Standard shipping (dry goods) provided by UPS:
For all orders placed before 10 a.m., delivery within 24 or 48 hours depending on location.
Free in-store collection
The customer can choose the ‘free in-store collection’ delivery method when confirming their order. In this case, the customer will be notified by email when their order is ready for collection. They must go to the point of sale during the indicated opening hours and present proof of identity to collect their products.

13/ Complaints and mediation
13.1/ Complaints
The products delivered by HUSO have been handled with the utmost care prior to packaging and shipping, which is carried out in such a way as to ensure that the products remain in perfect condition. In the event of a package being visibly damaged upon receipt, the customer must report the problem at the time of delivery and immediately note it on the delivery note. They must notify HUSO within 24 hours. In the event of missing goods in the package, the customer must notify HUSO within 24 hours of receipt of the package. After verification and investigation by its services, HUSO undertakes to resend the missing goods.

13.2/ Mediation
If the complaint submitted to HUSO is unsuccessful, or if no response is received within two months, the customer may submit the dispute relating to their order or these GTC between themselves and HUSO to any competent mediation service, which will attempt, independently and impartially, to bring the parties together with a view to reaching an amicable solution.
14/ Withdrawal period
14.1/ Conditions, period and terms of exercise
In accordance with the provisions of Article L. 221-18 et seq. of the French Consumer Code, the customer has the right to withdraw, without giving any reason, within fourteen days. This withdrawal period expires fourteen days after the day on which the customer, or a third party designated by the customer, takes physical possession of the last product ordered.
To exercise this right of withdrawal, the customer must notify HUSO, at the address indicated below, of their decision to withdraw by means of an unambiguous statement (e.g. letter sent by post, fax or email).

In order for the fourteen-day withdrawal period to be respected, the customer simply needs to send their notification of their intention to exercise their right of withdrawal before the expiry of this period. In all cases, the burden of proof for this exercise rests with the customer.
14.2/ Effects
In the event of withdrawal, all payments received from the customer, including delivery costs (with the exception of additional costs resulting from the customer's choice of a delivery method other than the least expensive standard delivery method offered) will be refunded without undue delay and, in any event, no later than fourteen days from the day on which the customer communicated their decision to withdraw. This deadline is deemed to have been met if the customer returns the products from the order before the expiry of the fourteen-day period. The refund will be made using the same means of payment as that used by the customer for the initial transaction, unless a different means has been expressly agreed.
The customer must return or hand back the products concerned to the above address without undue delay and, in any event, no later than fourteen days from the day on which the customer communicated their decision to withdraw. Only the price of the products and the shipping costs will be refunded; the return costs shall be borne by the customer. The products must be returned in their original packaging, unopened, with the seals intact and in perfect condition for resale, accompanied by any accessories and documentation.
HUSO may defer reimbursement until it has received the products covered by the order, or until the customer has provided proof of shipment of these products, whichever occurs first.
14.3/ Exceptionss
In accordance with the provisions of Article L. 221-28 4° and 5° of the Consumer Code, the right of withdrawal does not apply to products that are likely to deteriorate or expire rapidly, as well as products that have been unsealed by the customer after delivery and cannot be returned for reasons of hygiene or health protection.
15/ Guarantees
HUSO guarantees that the products delivered comply with current legislation and that they have been handled with the utmost care prior to packaging and shipping, which is carried out in such a way as to ensure that the products remain in perfect condition. If the customer is not fully satisfied, HUSO will refund the products concerned in the event of any deterioration in their quality. In this case, the customer must immediately return the package to HUSO for verification. However, HUSO cannot guarantee that the products will meet the personal taste expectations of the person consuming them. Perishable or semi-preserved products must be refrigerated between 0 and +4°C upon receipt. No returns or replacements will be accepted after the use-by date has expired.

HUSO reserves the right to modify and adapt the general terms and conditions of sale at a later date.
